Welcome to Prompterprise. These Terms of Service ("Terms") govern your access to and use of our website, AI prompt library, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing, browsing, or using Prompterprise ("Site," "Service," "we," "our," or "us"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. We may modify these Terms at any time, and continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

Prompterprise provides:

  • A curated library of AI prompts across multiple categories (writing, coding, marketing, research, creative).
  • An AI-powered prompt generator that uses Google's Gemini API to create custom prompts based on user inputs.
  • Premium prompt packs available for purchase through Gumroad.
  • Educational content including blog posts and guides about effective AI prompting techniques.

3. Eligibility

You must be at least 16 years old (or the age of majority in your jurisdiction, whichever is greater) to use this Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

4. User Accounts & Responsibilities

4.1 Account Creation

Certain features of the Service (such as newsletter subscriptions) may require you to provide an email address. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain and update your information to keep it accurate.
  • Protect the confidentiality of any account credentials.
  • Notify us immediately of any unauthorized use or security breach.

4.2 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to reverse-engineer, decompile, or disassemble any portion of the Service.

  • Attempt to gain unauthorized access to our servers, databases, or other users' accounts.
  • Use the Service to generate content that infringes on third-party intellectual property rights.

5. Intellectual Property

5.1 Our Content

All content provided through the Service, including but not limited to prompts, text, graphics, logos, icons, images, compilations, software, and the design, selection, and arrangement thereof, is owned by Prompterprise or its licensors and is protected by copyright, trademark, and other intellectual property laws. The "Prompterprise" name and logo are trademarks of Prompterprise.

5.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include:

  • Reselling, redistributing, or commercially exploiting our curated prompts.
  • Republishing our prompt library content on other websites or platforms without express written permission.
  • Using generated prompts for purposes that violate applicable laws or third-party rights.

5.3 Generated Content

Prompts generated by our AI Prompt Generator are created using Google's Gemini API. You retain the right to use any prompts you generate through the Service for your personal or commercial purposes. However, we do not guarantee that generated content is free from third-party intellectual property claims.

6. Third-Party Services

The Service may contain links to or integrate with third-party websites and services, including:

  • Google Gemini API: Our AI Prompt Generator uses Google's Gemini models. Your inputs are processed by Google in accordance with their terms of service.
  • Gumroad: Premium prompt pack purchases are processed entirely through Gumroad's platform. We do not store your payment information.
  • Google AdSense: Our Site displays advertisements served by Google AdSense, governed by Google's terms and policies.

We are not responsible for the content, privacy practices, or terms of use of any third-party services. We encourage you to review their respective terms and privacy policies before interacting with them.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • Results obtained from using the Service will meet your expectations or produce specific outcomes.
  • The prompts provided are legally sufficient for any particular use case (e.g., commercial advertising, legal documents).
  • The Service will remain available indefinitely or that content will not be modified or removed.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PROMPTERPRISE, ITS OWNERS, OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service, including AI-generated prompts.
  • Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Prompterprise and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of or access to the Service.
  • Your violation of these Terms.
  • Your violation of any rights of any third party.
  • Your content (including prompts you generate and subsequently use).
  • Your willful misconduct.

10. User-Generated Content

When you submit inputs to the AI Prompt Generator or otherwise provide content through the Service, you grant us a worldwide, royalty-free, non-exclusive license to use, store, and process such content solely for the purpose of providing the Service (e.g., sending your input to Google's Gemini API). You represent that you have all necessary rights to submit any content you provide.

11. Advertising & Revenue

The Service is supported by advertising revenue (primarily through Google AdSense) and sales of premium products via Gumroad. By using the Service, you acknowledge that:

  • We display third-party advertisements that may be targeted based on your browsing behavior.
  • We do not control the content or targeting of these advertisements.
  • You may encounter sponsored content or promotional material on the Service.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason (including violation of these Terms) or no reason. Upon termination:

  • Your license to use the Service will immediately cease.
  • We may delete or anonymize any personal data we hold about you, subject to applicable law and our Privacy Policy.
  • All provisions of these Terms that by their nature should survive termination shall remain in effect.

13. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of your country/jurisdiction, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation.
